Partitions and Subdivisions Information

A partition is a division of a tract of land into two or three parcels within one calendar year. Whenever a landowner wishes to sell or transfer a part of a tract of, or place a second home on property that already has a home on it, a land division is necessary.

No more than 3 parcels, including the "parent" parcel, can be created within one calendar year by partitioning. Any further parcelization (regardless of who owns the property) must be processed as a subdivision.

  • A subdivision requires a public hearing. The public hearing will be held within 45 days after the meeting at which the preliminary plan is first reviewed by the Planing Commission.

    Review procedure:

    The application is placed on the Planning Commission meeting agenda. The applicant will be notified of the date and tine of the meeting so they may be present.

    Note: If subdivision is proposed which includes private streets, all adjacent property owners will be notified of the proposal and the time and date of the meeting.

    • Planning Commission reviews the plans, staff report, and agency comments.
    • Planning Commission will tentatively approve, (some conditions may be applied) or deny the preliminary plan. Unless appealed, the decision shall become effective on the 11th day after being rendered. The approval or conditional approval is valid for one year from the effective date of approval
    • Within one year after the approval of the preliminary plan, a partition plat shall be submitted to the Planning Commission for approval.
    • Planning Commission reviews the plat shall be submitted to the Planning Commission for approval.
    • Planning Commission reviews the plat, and upon approval, the plat is returned to the applicant who submits it to the County Surveyor, with fees, for all the required signatures.
    • A final partition plat is recorded in the Lincoln County Clerk’s Office. Once the final plat is recorded, the partition is complete.
    • Planning Commission reviews the plans, staff report, and agency comments.
    • Planning Commission sets the date for public hearing. All property owners within 250’ of the property as well as applicant are noticed of the date of the hearing.
    • At the conclusion of the hearing, the planning Commission shall approve, conditionally approve, disapprove for cause, or when further information is required, postpone a decision on the preliminary plan. Unless appealed, the decision of the Planning Commission shall become effective on the 31st day after rendered. The approval or conditional approval is valid for two years from the effective date of that approval.
    • Within two years the plat shall be prepared and submitted to the Planning Commission for review.
    • Following the consideration of the plat, the Planning Commission shall approve, disapprove for cause, or, when further information is required, postpone a decision be postponed a decision on the plat. In no case shall a decision be postponed longer than 45 days. The applicant shall be notified in writing of the decision.
    • Unless appealed, the decision of the Planning Commission shall become effective on the 31st day after rendered. When the approval becomes effective the Planning Commission chairman shall sign the plat. The plat will then be delivered to the applicant who will submit, with fees, to the County Surveyor.
    • The Surveyor shall deliver the signed plat to the office of the County Clerk and notify the subdivider that it has been so delivered and may be recorded.

    Please review the code for requirements before submitting the final plat. The scale of drawings, type of paper must meet standards set by the county surveyor.
