BUSINESS LICENSE INFORMATION

Any person who is conducting, engaging in, carrying on, or practicing any business within the corporate limits of the City of Yachats must buy a Business License unless that person is exempt from buying a license, or expressly exempted by any other state or federal law. This includes anyone who is hired to repair, install, construct, design etc. within the city limits.

Any persons representing themselves, or exhibiting any sign or advertisement that they are engaged in a business or business activity within the City, are considered to be "in business" in Yachats and are required to obtain a business license.

Once the Business License Application Form and appropriate fees are submitted to the City office, the City Recorder will route the application to the necessary departments of the City for review. Upon a favorable recommendation from each department, the City Recorder will issue the license. If any department determines that the application should be denied, the City Recorder will notify the applicant of the denial and the reasons for the denial.

If there is a transfer of ownership of any business, the business license may be transferred by application to the City Recorder within thirty (30) days after the transfer, or the license is deemed to automatically expire. The City may approve the transfer upon finding that the new applicant meets the requirements of the ordinance (s). In the event of transfer of ownership, and the new owner changes the name of the business, or makes significant changes in the inventory or activity, it shall be considered a new business.

If a business relocates, the owner needs to reapply to the City Recorder to transfer the business license. The City may issue the license upon finding that the new location meets the requirements of the ordinance (s).

Business licenses (except those issued on a daily basis) are annual. Renewal forms and the fee are due on January 1^st of each year. They are considered delinquent on February 1^st, and an additional fee of $40.00 must be paid.

If your business is physically located within the city limits there may be other issues you will need to consider as well for things such as Signs, parking, zones, etc.

If you plan to conduct your business from your home please contact the City Recorder . There are separate requirements and produces that pertain.

A person engaged in business in more than one location or in more than one business is required to make a separate application and pay a separate license fee for each business or location. There are exceptions to this. Please contact the City Recorder if you have a question.
If a licensed business contracts to sponsor an outside activity, such as a rodeo, circus, carnival, etc., a separate business license necessary, and the application fee and business license fee must be paid.
Granting of a business license for a circus, carnival, tent show, or public event of a commercial nature within the City is at the discretion of the city Council and there are special requirements that need to met. Please see the code.
Notify the City within ten (10) days of any change in material information contained in the application, related materials, or license.
Display a business license upon request to any person with whom he/she is dealing as part of the licensed activity or to an officer or employee of the City.
